Purchase terms

1. Scope

These terms apply to purchases from PuzzleWithFriends (provider as stated in the legal notice, “we”): Puzzle Gold, the Puzzle Plus subscription and puzzles or packs you buy with gold. The terms of use apply as well.

You can buy from the age of 18. If you’re younger, you need your parents’ consent.

2. Ordering and payment

You pay for gold packs and Plus via Stripe (Stripe Payments Europe, Ltd., Ireland). Clicking the pay button on Stripe’s page is a binding offer; the contract is concluded when we receive the payment. Stripe emails you the receipt.

If you buy from outside Germany, the purchase runs through Stripe Managed Payments: the seller in the payment is then Sold through Link, LLC (USA), a Stripe affiliate. It sells you the gold or Plus as a reseller, charges your country’s tax and sends you the receipt; its terms, which you see when paying, also apply to payment, withdrawal and refunds. What you get from us with gold and Plus is governed by these purchase terms.

The prices shown at the time of purchase apply, in euros. For purchases in Germany we don’t charge VAT as a small business (§ 19 UStG); for purchases through Stripe Managed Payments your country’s tax is included in the price.

You can buy from the countries we have enabled for it.

3. Puzzle Gold

Puzzle Gold is an in-game currency. You can only use it at PuzzleWithFriends, for puzzles and packs. It isn’t money; we don’t exchange it back or pay it out. You can’t transfer or sell it.

Bought gold never expires. Plus gold from the subscription expires one month after it is credited. When you pay, the gold that expires first is used first.

An artist code gives you a one-time discount on your next gold pack; codes don’t apply to Puzzle Plus. Codes for puzzles or Plus days never unlock gold.

4. Puzzles and packs

If you buy a puzzle or pack with gold, you may play it at PuzzleWithFriends, also with friends in your room. The image itself still belongs to its creator.

Where an artwork download is offered with your purchase, you can download the artwork in your library, for private use only.

If we have to remove a puzzle for good (e.g. because rights are missing), you get the gold you paid for it back as bought gold.

5. Puzzle Plus

Puzzle Plus is available monthly or yearly. It includes the monthly amount of Plus gold shown when you subscribe, Plus puzzles to claim (they stay in your library after the subscription, except after a withdrawal), all themes, the Glitter trail, larger rooms, puzzling your own images, the Plus star and no ads.

The subscription renews automatically for the same period until you cancel. You can cancel at any time to the end of the current period, directly under “Manage Plus” (“Cancel contracts here”) or by email. Plus keeps running until then.

Your subscription keeps its price. If we change the price of Plus, the new price only applies to subscriptions that start afterwards.

We may cancel your subscription with 30 days’ notice to the end of a period, for example if we no longer offer Plus in this form. Time you have paid for stays yours.

6. Right of withdrawal

As a consumer you can withdraw from a purchase within 14 days without giving a reason. The period starts when the contract is concluded. Send us a clear statement to [email protected]. It’s enough to send it before the period ends.

After a withdrawal we refund everything you paid within 14 days, using the same payment method. We deduct the gold from that purchase again.

Gold: on Stripe you agree that we credit the gold right away and confirm that you lose your right of withdrawal as a result. Once the gold is in your account, the right of withdrawal expires (§ 356(5) BGB).

Plus: Plus starts right away at your request. If you withdraw within the 14 days, you only pay for the days up to the withdrawal; we deduct the Plus gold of that period and remove the Plus puzzles you claimed during it from your library.

If you buy through Stripe Managed Payments, Stripe asks for the consents when you pay. You can then also declare the withdrawal to Stripe; the refund goes through Stripe and we deduct the gold as above.

Template: “I hereby withdraw from the contract I concluded for (gold pack or Plus), ordered on (date), name, email address of the account, date.”

7. Refunds and chargebacks

If we refund a payment (e.g. after a withdrawal or as a goodwill gesture), we deduct the gold from that payment again. If you’ve already spent it, we may block gold spending until the amount is settled.

The same applies to a chargeback through your bank or card. Please write to us first; it’s quicker to sort out.

8. End of the service

If we shut down PuzzleWithFriends, we’ll announce it at least 3 months in advance. From the announcement on, we no longer sell gold. Until the end, you can spend your gold as usual and download artworks with download permission.

We refund paid Plus periods that extend beyond the end pro rata.

9. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body and health. For slight negligence, we are only liable for breaches of essential obligations and only for foreseeable, typical damage. Liability under the Product Liability Act remains unaffected.

10. Changes

If we change these terms, the changes apply to new purchases. For a running Plus subscription we’ll tell you at least 30 days in advance; until then you can cancel. Gold you already have keeps the rules under which you bought it.

11. Law and dispute resolution

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. As a consumer living in the EU, you keep the protection of the mandatory rules of your country.

We do not take part in dispute resolution proceedings before a consumer arbitration board.

The German version is binding.
